Sometimes clients come to us for something other than a routine sale. Sometimes they come when the situation is close to a dead end.
The owners of a completed apartment who had already found a buyer approached GREEN CITY REAL ESTATE. At first glance the task looked simple. But a detailed review of the documents made one thing clear: this deal belonged in the high-complexity category.
The starting conditions we faced:
• the property was part of an estate following the death of the original owner
• there were three heirs, one of them a minor
• all of the owners were non-residents of the UAE
• the inheritance case had been before the court for almost two years
• critical arrears had built up on the developer's payment plan
• there was a genuine risk of the contract being cancelled and the investment lost
• the sale was blocked by the court because of the age of one of the owners
• on top of that, the property was blocked by the developer
At this point most deals simply stop. We took a different route.
The solution:
We began with a full legal and procedural audit and built a step-by-step strategy agreed with every party involved: the owners, the buyer, the developer and the government authorities.
Key actions:
• we negotiated with the developer and had the accumulated payment-plan arrears written off in view of the court circumstances
• the buyer, under our supervision, paid up to 100% of the property value
• we found a legal way to make the court payment, given that the court accepts transfers only from local accounts
• we promptly lifted the developer's block and obtained the NOC in a single working day, spent entirely at the developer's office
• we guided the removal of the court restrictions and the court's dealings with the DLD
The hardest moment:
While the approvals were under way, construction of the building was officially completed. That created a critical legal conflict:
• for the court, the property was still registered under OQOOD
• to register the transaction, the DLD now required the Title Deed
In situations like this the process can drag on for months.
We resolved it by hand. No waiting, no formal brush-offs.
Being there in person at the departments, dealing directly between divisions, tracking the handover of documents at every stage, answering official requests instantly. The clock was running in hours: every party to the deal was a non-resident and was in Dubai for a limited number of days.
The result:
After 6 months of work, hundreds of letters, dozens of visits in person to government bodies, several sleepless nights and approvals at every level, including final sign-off from the management of the Dubai Land Department, the deal was successfully completed.
The property is sold.
Title is registered correctly.
The investment is intact.
Every party walked away from the deal with no risks and no legal consequences.
What this case says about us:
We do not sell "just apartments".
We take responsibility for the outcome, even when the path to it is difficult and out of the ordinary.
If a situation looks hopeless, that does not mean there is no solution.
More often it means the right experience, patience and the ability to work at the level of the system are what is needed.
GREEN CITY REAL ESTATE
